Ruling Expected Tomorrow in Virginia

Judge Henry Hudson is expected to hand down his ruling tomorrow in the Virginia case.

This case is the only case so far to have held a hearing for Summary Judgment.  The Florida case (involving 20 states as Plaintiffs) will hold its Summary Judgment hearing this Thursday, December 16.

Ken Cuccinelli, the VA attorney general representing the commonwealth, is defending a state statute that forbids any requirement that Virginians purchase health insurance. 

If Judge Hudson rules tomorrow that the health reform law (commonly called ObamaCare) is unconstitutional, a higher court will review his decision.  If he rules against the plaintiff, then Cuccinelli will almost certainly take the case to an appellate court.

Ultimately, the Supreme Court will determine the constitutionality of the law.
